VB Terms of Use

These VB Terms of Use (“Terms”) govern your access to and use of the website available at https://vbsecretchallenges.com, including its pages, features and content (collectively, the “Site”), which is offered by VB Secret Challenges (“VB”, “we”, “us” or “our”). The Site is operated by Vinícius Bedum, an individual based in Brazil. In these Terms, “you” and “your” refer to any person who accesses or uses the Site.

The VB Privacy Policy (“Privacy Policy”), available at https://vbsecretchallenges.com/privacy, and the VB Cookie Policy (“Cookie Policy”), available at https://vbsecretchallenges.com/cookies, are incorporated into these Terms by reference.

1. Acceptance and capacity

1.1 By accessing or using the Site, you agree to these Terms. If you do not agree to these Terms, you must not use the Site.

1.2 You must be able to enter into a binding agreement under the law of the country where you live.

2. The Site and the origin of the information

2.1 Description. The Site is free of charge and gathers, in one place, links to challenges held on the platform operated by Strava, Inc. and its affiliates (“Strava”) at https://www.strava.com. The Site shows the challenges that start soon, the challenges that are active and the challenges that ended recently, each with a link to its page on Strava. Each challenge is run by a person or brand (the “Organizer”).

2.2 Public challenges. The challenges listed on the Site are public: any person who has the link can open the page of the challenge and join it. We call them “secret” only because they do not appear in a place that is easy to find, not because they are confidential or restricted.

2.3 Purpose. We organize this public information in one place to help the community of people who enjoy challenges, collect badges and look after their health.

2.4 What we do not do. We do not create or host the challenges, we have no access to your account or to the account of any other person, and we do not record activities. Participation in a challenge takes place on Strava, under the terms of Strava.

2.5 Origin of the information. The information on the Site comes from manual curation carried out by us, based on the public page of each challenge, and from the Submissions made by the community, as defined in section 5.

2.6 Independence. The Site is independent. VB is not affiliated with, sponsored by or endorsed by Strava or by any Organizer.

3. Accuracy and Organizer responsibility

3.1 The dates, rules, prizes and eligibility conditions of each challenge are set by its Organizer and may change without notice to us. The page of the challenge on Strava is the authoritative source.

3.2 We take care with what we publish, but we do not guarantee that the information on the Site is complete, accurate or up to date. Before you join a challenge, you must check its rules on the page of the challenge.

3.3 The Organizer is solely responsible for the challenge, including its rules, its prizes and its results.

4. Acceptable use

4.1 The Site is intended for personal use and requires no account.

4.2 You must not:

  • collect the content of the Site in bulk or by automated means beyond what the robots.txt file of the Site allows, or in a manner that overloads the Site;
  • attempt to interrupt the Site or to circumvent its protections, including the human verification and the limits on Submissions;
  • use the form to send links that are not challenges, false information, the profile of another person, or repeated or automated Submissions;
  • use the Site for any unlawful purpose.

5. Submissions

5.1 What you send. You may suggest a challenge through the form on the home page of the Site by sending us the link to that challenge (a “Submission”). If you want credit, you also send us the link to your own Strava profile and authorize the use of the name and the photo of that profile for the credit.

5.2 Your declarations. By making a Submission, you declare that the link leads to a public challenge and, if you ask for credit, that the profile indicated is your own.

5.3 Permission for credit. If you ask for credit, you give us a limited, non-exclusive and revocable permission to use the name and the photo of that profile solely to credit your contribution, in the publications of our community and on the Site, if the Site comes to display credits. This permission grants us no other right, and you may withdraw it at any time.

5.4 Our discretion. We decide at our sole discretion whether a suggested challenge is listed on the Site. We may accept, refuse or remove a Submission at any time.

5.5 Removal. You may ask us to remove the profile link and the authorization through the contact in section 18.

5.6 No compensation. A Submission does not give you any right to payment or reward, and it does not oblige us to list the challenge or to give credit.

6. Third-Party Content and trademarks

6.1 The names, trademarks, logos, badge images and other material of the challenges, of the Organizers and of Strava (“Third-Party Content”) belong to their respective owners.

6.2 Third-Party Content appears on the Site only to identify each challenge and to point to its page. Its presence does not indicate any partnership, sponsorship or endorsement.

7. Our content

7.1 The text, the design and the code of the Site that are our own belong to VB. You may not copy or redistribute them, except as the law allows.

7.2 Nothing in these Terms gives you any right over Third-Party Content, which belongs to its owners.

8. Removal and correction requests

8.1 If you are an Organizer or a rights holder and you want a challenge, a name or an image to be removed or corrected, you may ask us through the contact in section 18, indicating the challenge and the reason.

8.2 We will review each request promptly, and we will remove or correct the content where the request comes from the party that organizes the challenge or holds the right.

9. Third-party sites and links

9.1 The Site contains links to websites and applications operated by others, including Strava and the payment page referred to in section 10.

9.2 We do not control those websites and applications, and we are not responsible for their content, availability, terms or privacy practices. Your use of them is governed by their own terms.

10. Voluntary support

10.1 The Site has a link for voluntary contributions (“Buy me a coffee”). A contribution is optional and is processed on a payment page of an external provider (Stripe), under the terms of that provider.

10.2 A contribution does not purchase any product, service, access or advantage. The Site works in the same way for every person.

11. Availability, changes and suspension

11.1 We may change, interrupt or discontinue the Site at any time, in whole or in part, without prior notice.

11.2 We may limit or suspend your access to the Site if you breach these Terms.

12. Disclaimer of warranties

To the fullest extent permitted by law, the Site is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties as to accuracy, completeness, availability or fitness for a particular purpose.

13. Limitation of liability

13.1 To the fullest extent permitted by law, VB will not be liable for any indirect or consequential loss, or for any loss arising from:

  • your use of the Site or your inability to use it;
  • information on the Site that is incomplete, inaccurate or out of date;
  • the challenges, their rules, their prizes or their results;
  • Third-Party Content or the websites and applications to which the Site links.

13.2 Nothing in these Terms excludes or limits any right that you have, or any liability that we have, that cannot be excluded or limited under the law that applies to you, including consumer protection law.

14. Health and safety

Physical activity involves risk. You decide whether and how to take part in a challenge, at your own risk. You must respect your own limits and seek professional advice where necessary.

15. Changes to these Terms

We may update these Terms. The date at the top of these Terms indicates the version in effect. If you continue to use the Site after a change takes effect, you accept the updated Terms.

16. Governing law

These Terms are governed by the laws of Brazil, without prejudice to the mandatory consumer protection provisions of the country where you live, including in the European Union and the European Economic Area.

17. General provisions

17.1 Severability. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in effect.

17.2 No waiver. If we do not enforce a provision of these Terms, that does not mean that we waive it.

17.3 Entire agreement. These Terms, together with the Privacy Policy and the Cookie Policy, are the entire agreement between you and VB concerning the Site.
